It took the jury only a single ballot at Nezperce last Friday night to free James Willsey from the charge of manslaughter for the shooting of Parker Nicholson Jr, at Winchester on Halloween night.  Willsey had been on trial on a charge of murder but Judge McNaughton in his instructions to the jury advised them to acquit Wilsey on that charge and only consider the case from a point of manslaughter.  He declared that a man has a right to defend his possessions and property against unlawful seizure, using such force as seems reasonably necessary, and that under certain conditions acts of defense might be justifiable even though they might result in death.  The case went to the jury at 6 o'clock and a verdict of acquittal was returned at 8:30, only one ballot being taken to ascertain the result.
