Morrison Killed by Daniel McGann Near Stuart

Named Hether Claimed the Land and Morrison Was Helping Haul Rails –
McGann Drove Them Off and Shot at Both

Stuart,
March 13 – (Special) – John L. Morrison was shot and killed by
Daniel L. McGann at 4 p.m. yesterday.
A difficulty had existed for some time between McGann and a
Swede, Nelson Hether, concerning the possession of a piece of land.
Hether had built a cabin and yesterday, accompanied by Morrison,
who had championed the rights of Hether against McGann, was hauling
rails upon the tract, and was assisted by Morrison in the work.
McGann appeared upon the scene armed with a Winchester and
ordered him to leave the premises at once, at the same time making
threats with the gun. After
some words both started for their homes, Hether in one direction with
the team and Morrison in the opposite.
Two shots were fired at Hether without effect, then another was
fired and Hether heard Morrison cry out.
Hether
came to Stuart and a warrant was placed in the hands of the constable,
who made the arrest of McGann this morning, without resistance. After the shooting Heather’s house was burned and his wagon
dumped into the canyon.
McGann and his wife
talk quite freely about the matter and apparently seem to think the
killing entirely justifiable
The
coroner arrived here at sundown and will go to the scene of murder early
in the morning to hold an inquest.
The killing occurred about six miles northeast of this place.

from Grangeville this evening states that the trial of Daniel McGann for
the murder of John T. Morrison began this morning, and after the regular
panel had been exhausted, a special venire for 12 jurymen had been
placed in the hands of the sheriff |

Sheriff
Agnew has received papers from the district court at Lewiston for
service upon D.L. McGann, who is serving a 10 year sentence at the
penitentiary for manslaughter. The
convict’s wife, Emily J. McGann, has sued him for divorce, alleging as
a cause his conviction of crime. The
McGanns were married in Idaho County, November 29, 1900.
